1. Introduction and Scope of Services

Flawless Beauty Abroad (“The Company,” “We,” “Us”) acts exclusively as a medical tourism facilitator and concierge service. We are not a medical provider. We do not practice medicine, provide medical advice, or operate medical facilities.

Our services are limited to:

• Facilitating communication between clients and third-party medical providers in Colombia.
• Coordinating logistics such as accommodation, local transportation, and concierge support.
• Providing general information regarding medical tourism destinations and facilities.

By using our website, booking our services, or traveling with us, you (“The Client,” “You”) acknowledge and agree to the terms outlined below.

2. No Medical Advice

The content provided on this website, in our brochures, or by our concierge staff (via email, phone, or text) is for informational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

• Always seek the advice of your physician or other qualified health providers with any questions you may have regarding a medical condition.
• Never disregard professional medical advice or delay in seeking it because of something you have read on this website.
• Flawless Beauty Abroad does not recommend or endorse any specific tests, physicians, products, procedures, or opinions.

3. Relationship with Medical Providers (Third-Party Liability)

You acknowledge that the medical professionals (Surgeons, Anesthesiologists, Nurses) and facilities (Clinics, Hospitals) in Colombia are independent contractors and are not employees or agents of Flawless Beauty Abroad.

• The contract for your medical care is strictly between You and the Medical Provider.
• Flawless Beauty Abroad is not responsible or liable for any act, error, omission, injury, loss, accident, delay, nonperformance, irregularity, or any consequence resulting from the negligence or default of any Medical Provider.
• Any dispute regarding the outcome of your medical procedure, medical negligence, or malpractice must be resolved directly with the Medical Provider and the medical facility in the jurisdiction of Colombia.

4. Assumption of Risk

You understand that:

• Surgical Risks: All medical and surgical procedures carry inherent risks, including but not limited to infection, scarring, dissatisfaction with results, complications, and in rare cases, death. You voluntarily assume all risks associated with your elected procedures.
• Travel Risks: International travel involves risks including, but not limited to, political instability, changes in visa requirements, health hazards, and travel delays. You assume full responsibility for your safety and personal belongings while traveling.

5. Medical Clearance and Candidacy

The decision to perform any procedure is at the sole discretion of the Medical Provider. Flawless Beauty Abroad cannot guarantee that you will be deemed a suitable candidate for surgery upon your physical examination in Colombia.

Important: If the surgeon determines, in their professional medical opinion, that it is unsafe to proceed with your surgery, Flawless Beauty Abroad is not liable for the cancellation of the procedure. (Refer to our Refund Policy for specific terms regarding this scenario).

6. Complications Insurance

While Flawless Beauty Abroad includes a medical complications insurance policy as part of your package, the terms, coverage limits, and exclusions are dictated solely by the Insurance Provider.

Flawless Beauty Abroad is not an insurance company.

Any claims must be filed directly with the Insurance Provider. We will assist in facilitating this communication but do not guarantee the outcome of any claim.

7. Passport, Visa, and Entry Requirements

It is the sole responsibility of the Client to ensure they have valid travel documents, including a passport valid for at least six (6) months beyond the date of travel. Flawless Beauty Abroad is not responsible if you are denied entry into Colombia or denied boarding by airlines due to improper documentation.

8. Recovery Sanctuary & Concierge Services

Our “Recovery Sanctuaries” and associated concierge services (including meals, massage therapy, and salon services) are non-medical amenities.

• The nursing staff provided at the Recovery Sanctuary offers post-operative assistance and caregiving, not emergency medical treatment.
• In the event of a medical emergency, standard emergency protocols will be followed, involving transfer to a hospital.

9. Governing Law

These Terms and Conditions, and any dispute arising out of the booking, payment, or facilitation services provided by Flawless Beauty Abroad, shall be governed by and construed in accordance with the laws of the State of Maine, without regard to its conflict of law principles.

10. Dispute Resolution & Forum Selection

You acknowledge and agree that Flawless Beauty Abroad acts solely as a facilitator. Therefore, disputes shall be handled as follows:

If any provision of these Terms is found to be unenforceable or invalid under Maine law, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

12. Cancellation and Refund Policy

We understand that life happens. However, coordinating international medical travel requires significant advance payment to third parties. Our policy is as follows:

  Deposit ($1,000): The initial deposit is non-refundable after [e.g., 72 hours] of booking. This fee covers the administrative cost of reserving your surgical date and coordinating your itinerary.

  60-Day Payment: If you cancel between 60 and 30 days prior to your arrival, you will receive a refund of 50% of the total package price.
• 3
  Less than 30 Days: If you cancel less than 30 days prior to arrival, no refund will be issued, as funds will have already been disbursed to secure medical teams, facilities, and accommodations.

  Medical Cancellation: If the Surgeon in Colombia determines during the pre-operative consultation that you are medically unsafe to undergo surgery, you will be refunded the cost of the medical procedure only. Travel, accommodation, and administrative fees are non-refundable as these services have already been rendered or reserved.
